Практика применения антидемпинговых и компенсационных мер в ЕС в контексте ВТО
Аннотация
Рассмотрены особенности применения антидемпинговых и компенсационных мер в ЕС, в том числе правовая основа и институциональные особенности применения указанных мер, практика их оспаривания в судебной системе ЕС и в рамках разрешения системы споров ВТО. Споры ВТО исследованы с точки зрения процедурных аспектов проведения антидемпинговых и компенсационных расследований, а также содержательных аспектов практики установления нормальной стоимости, экспортной
цены, установления ущерба и причинно-следственной связи. Наиболее спорные аспекты практики Евросоюза рассмотрены в текущих и будущих спорах ВТО с учетом изменений базового антидемпингового регламента в части установления «значительных искажений» на рынке экспортирующей страны. Проанализировано влияние правоприменительной практики ВТО на право и практику Европейского Союза, а также перспективы оспаривания права и практики ЕС в рамках системы разрешения споров ВТО.
