Подходы к обоснованию установления изъятий из национального режима или особенностей осуществления закупок государствами — членами Евразийского экономического союза

Abstract

The article is devoted to searching the economic solutions to the problem of establishing exemptions from the national treatment or the peculiarities of procurement on the example of the Eurasian Economic Union. We analyze the legal framework of the exemptions in EAEU with the practical example of its application, as far as the features of the free-trade principle in public procurement implemented in international documents on the examples of WTO, APEC, OECD, UN, TI and in foreign legislation on public procurement on the examples of EU, USA, China. As a result of the analysis the following conclusions are drawn: the validity of exemptions from the national treatment in public procurement, despite the common desire to implement the free-trade principles, and at the same time the lack of clear economic criteria for evaluating their validity. We propose the solution of the problem on the example of EAEU by improving the established procedure for the consideration by the Eurasian Economic Commission of the notifications of the member States on the adoption of the acts establishing exemptions from the national regime through the introduction of the effectiveness and efficiency criteria.
