Material retardation of the establishment of an industry due to dumping import: foreign practices
Abstract
Practices of application of antidumping measures on the ground of material retardation of the establishment of an industry due to dumping import are analyzed. The multilateral rules in the said area are discussed as well as practices of some countries in particular USA and India. The article deals with several cases of application of antidumping measures on the ground of material retardation of the establishment of an industry due to dumping import and related trade disputes. Author discusses in detail the criteria used to identify industry as “infant” industry for the purposes of investigations prior to introduction of antidumping measures.
